O ESTUDO DO DIREITO COMPARADO NA SOLICITAÇÃO DE REFÚGIO COM BASE NA ORIENTAÇÃO SEXUAL E IDENTIDADE DE GÊNERO

Este artigo científico aborda o estudo do direito comparado no contexto da solicitação de refúgio com base na orientação sexual e identidade de gênero. O objetivo principal é analisar como o Brasil e a Espanha se destacam diante dos requerentes de refúgio que fogem da perseguição devido à sua orientação sexual ou identidade de gênero. O estudo do direito comparado permite uma compreensão mais abrangente das políticas e práticas relacionadas a refugiados LGBTQIAPN+ em todo o mundo, destacando os desafios e as melhores práticas em diferentes jurisdições. A análise apresentada neste artigo contribui para o desenvolvimento de políticas mais inclusivas e efetivas de refúgio para indivíduos LGBTQIAPN+.
