O DIREITO COMO MECANISMOS DE CÁLCULO ESTATAL DE PODER NA BUSCA PELA VERDADE PROCESSUAL

Resumo

A luta pela justiça, sobretudo pela produção dos meios de prova para alimentar um processo claro, imparcial, onde todos pudessem ser julgados como pares é tão intensa e antiga quanto seus próprios ideais.No entanto, com o surgimento do Estado e posteriormente seu crescimento em virtude e para manutenção do capitalismo, tal busca tomou diferentes rumos e até mesmo os ideais de justiça foram em grande parte substituídos por ideais de cunho político.Diante disto há uma série de novas perguntas e respostas que devem ser realizadas e respondidas pelo Direito, principalmente sobre o seu papel social.

ABSTRACT

The fight for justice, over all on how trials are made to feed a clear and impartial process, where everyone could be judged as equals is so intense and antique as it’s on ideals. Nevertheless, with the appearance of the State and subsequently it’s growth in face of the maintenance of capitalism this pursuit toke a different route and even the ideals of justice were in most cases replaced for political ideals. In the presence of it, there are an enormous number of questions and answers that must be made for the law, mainly about it’s
position in the society.
